Wrongful Death Attorney
We understand first hand how a wrongful death can affect you. Most of us go through life expecting that we will have the opportunity to grow older with our loved ones near us. Whether it is a spouse, a child, or a parent, we usually give no second thought to expressing ideas and plans that we can put off until “tomorrow” or “next year” or “someday” as we carry on with our busy daily lives. Even when someone close to us becomes seriously ill, we often still have time to assimilate and adjust to the new reality; we make the time to recognize and express how much that person means to us.
NEGLIGENCE UNDER GEORGIA LAW
In Georgia, liability for negligence requires four elements: The defendant owed a duty to a plaintiff The defendant breached the duty The plaintiff was injured as a result of the defendant’s breach; and The injury caused the plaintiff to incur damages.
But when someone close to you is gone in an instant, the experience is devastating. And it is even more distressing and painful when you know that the death was avoidable—avoidable because the person who caused it was simply heedless of the safety and welfare of others or acted with wrongful intent.
Founding principal attorney André Dennis knows exactly what the feeling is like: his own father was killed by a negligent driver. His first contact with the concept of “wrongful death” was through this experience and through the insurance company’s subsequent attempts to offer him an unjust settlement. This inspired him to found The Dennis Law Firm and to dedicate his practice to seeking justice for clients who have been seriously injured or lost loved ones due to the careless or wrongful conduct of others. Having been a victim of negligence himself, Mr. Dennis understands what you are going through, and approaches each and every case with the compassion and dedication of someone who has experienced the same kind of loss that you have.
WHAT IS “WRONGFUL DEATH”?
Under Georgia law, “wrongful death” is a personal injury claim through which a close relative of someone who has died can recover damages if the death was caused by wrongful means. Claims typically arise in cases involving:
- CAR ACCIDENTS, TRUCK ACCIDENTS, OR MOTORCYCLE ACCIDENTS.
- MEDICAL MALPRACTICE.
- DEFECTIVE PRODUCTS.
- CRIMINAL MISCONDUCT, INCLUDING MURDER, ABUSE, OR GROSS NEGLECT.
- THE PLAINTIFF IN A WRONGFUL DEATH LAWSUIT MUST SHOW THAT:
- THE DEATH WAS CAUSED BY THE DEFENDANT.
- THE DEFENDANT’S CONDUCT WAS INTENTIONAL, RECKLESS, OR NEGLIGENT.
- THE PLAINTIFF WAS CLOSELY RELATED TO THE DECEASED, AS SPECIFIED BY STATUTE.
- THE WRONGFUL DEATH CAUSED THE PLAINTIFF TO SUFFER MONETARY DAMAGES.
WHAT DAMAGES ARE AVAILABLE IN A WRONGFUL DEATH ACTION?
Damages are defined by statute as the “full value of the life of the decedent without deducting for any of the necessary or personal expenses of the decedent had he lived.” As a practical matter, damages may include:
- Costs associated with the death, such as medical care and funeral costs.
- Loss of support and services, which not only includes lost income, but the value of lost services such as homecare and childcare.
- For spouses, children, and parents, loss of companionship and protection.
- Damages for pre-death pain and suffering.
THE GOLDEN RULES ALL CAR ACCIDENT VICTIMS SHOULD FOLLOW
There are 5 “Golden Rules” we recommend that all car accident victims adhere to in order to protect their rights and interests:
- No matter how small the accident is, ALWAYS get an accident report.
- Take photos of any vehicle damage, as well as the scene of the accident.
- Contact your insurance company right away. Discuss ONLY the accident. DO NOT discuss whether you are injured.
- Even if you do not think you are hurt or have only minor injuries, see your doctor or visit an urgent care or emergency medical facility as soon as possible. Not every injury manifests itself right away.
- Promptly consult a qualified personal injury lawyer to find out what your rights are and what remedies may be available to you. Don’t trust an insurance company to tell you your rights.
LET US FIGHT FOR THE COMPENSATION YOU DESERVE
If you have recently lost a spouse, parent, or child, we know how difficult it is to address the practical reality of your economic situation in the midst of your suffering. We also know that money damages can never come close to compensating you for the loss of someone you love. But it is only right that the party responsible for your suffering should not cause you the further distress of forcing you to cope, alone, with the expenses and responsibilities of your loved one’s passing, or that your spouse, parent, or child would have provided for you.
Wrongful death damages cannot heal your grief, but they can alleviate many of the most negative economic consequences that are brought about by the death of your loved one. When your family’s future well being may well depend upon pursuing and obtaining a damages award, you can be sure that the Atlanta personal injury lawyers at The Dennis Law Firm will fight to make sure your rights and your interests are fully protected.
